USCIS Resumes Premium Processing for FY 2019 H-1B Cap Petitions

Starting Monday, Jan. 28, U.S. Citizenship and Immigration Services (USCIS) will resume premium processing for all fiscal year 2019 H-1B cap petitions that are currently pending. This includes petitioners eligible for the advanced degree exemption, also known as the “master’s cap.”

USCIS also said that petitioners who received a Request for Evidence (RFE) for pending FY 2019 cap petitions should include RFE responses with any request for premium processing.

However, the temporary suspension of premium processing remains in effect for all other categories of H-1B petitions, with the exception of extensions without amendments/no change, and cap-exempt employers are allowed to premium, per USCIS's original announcement.
