About The H-1B Cap Lottery

The H-1B cap lottery opens each government fiscal year. During this time, U.S. Citizenship and Immigration Services (USCIS) grants 85,000 new H-1B visas. The “cap” refers to the limit on the number of H-1B visas issued in a year. Typically, USCIS receives more than 85,000 filings, which is why they conduct a random selection, or lottery, on the H-1B cap cases received.

About Electronic Registration

Last year, USCIS changed the H-1B cap lottery selection process. Now, all employers are required to register prospective H-1B beneficiaries via its online system called myUSCIS. If your employer’s registration is selected in the lottery, they may move forward with submitting the H-1B cap petition on your behalf.

What You Can Expect Next

The legal team will assist your employer with the electronic registration process. You can expect a case to open in your Envoy account, where you will need to complete a questionnaire and upload documents. The legal team will review all the documents and information that you and your employer provide and will proceed with filing the Labor Condition Application (LCA) and prepare the case for filing.

After USCIS conducts lottery selection, the legal team will be notified if your employer’s registration is selected. Once your employer confirms next steps, the legal team will move forward with a final review of the case before submitting it to the government.
