- On 28 February 2023, the United Kingdom introduced further guidance for the completion of right to work checks
The government of the United Kingdom (UK) published new information for employers conducting right to work (RTW) checks on 28 February 2023. This new information includes the following:
- Clarifying the requirements and penalties for employers who work with an identity service provider (IDSP) to complete a RTW check for a British or Irish employee. As a result, the government noted that employers continue to be responsible if any issues occur with the RTW check, even if the IDSP was responsible for checking an employee’s photo and immigration status.
- Expanding the options for employers who seek to extend a work visa for employees who do not hold acceptable documentation to complete the RTW check.
- Introducing guidelines for conducting an online RTW check for foreign nationals holding short-term Biometric Residence Permits (BRPs).

What are the Changes?
The government of the UK introduced new guidelines for certain aspects of the RTW check process. According to the government announcement, these new guidelines apply to all RTW checks conducted on or after 26 January 2023.
