8 Impact of Recent Policy Changes Issued April 2017 – Since then, employers have experienced the following: • Increased scrutiny of petitions • Increased issuance of RFEs (percentage of RFEs issued for H-1B cases jumped to 60% during Q4 of 2018) • Rescission of long-held USCIS policies • Increased wage requirements for some H-1B visas • Longer government processing times • An increase in unexpected site visit investigations Buy American, Hire American Proposes Changes to H-1B Cap-Subject Petitions On January 30, 2019, the Department of Homeland Security proposed changes to H-1B cap petitions • The final changes relate to two areas: • Electronic Registration: No change for this year's FY 2020 cap season • Order of the H-1B lottery selection: Change will take effect in this year's FY 2020 cap season
